1. What are differences between cannabinoids, hemp and cannabis?

Cannabinoids – lower-potency items such as THC gummies and beverages that became legal to sell, possess and consume in 2022 by individuals at least 21 years of age.

Hemp – a class of cannabis that is less than 0.3% delta-9 THC often used for medicinal purposes.

Cannabis – a type of high-potency marijuana plant that can be smoked, vaped, or consumed by individuals at least 21 years of age.

2. When did adult-use of cannabis possession and consumption become legal in Minnesota?: In spring 2023, the Minnesota Legislature legalized and decriminalized the use of cannabis in Minnesota, effective Aug. 1, 2023. People ages 21 and up now can possess up to 2 ounces of cannabis and consume cannabis without legal penalty. Cities have additional rules guiding where it can be consumed and sold.

3. Where can you smoke/vape cannabis/hemp in Woodbury?

Cannabis can be smoked in your home or on private property, if allowed by the owner. However, smoking or vaping adult-use cannabis is prohibited in multifamily housing buildings.

In Woodbury, cannabis/hemp smoking, vaping, and any form of electronic delivery method is not allowed in public spaces – that means sidewalks, parks, and even store parking lots. The Minnesota Clean Indoor Air Act applies, so cannabis smoking is not allowed in buildings available to the public.

All cannabis use is prohibited at public or charter schools. It also cannot be consumed in vehicles – whether you are driving or riding as a passenger.

In addition, cannabis cannot be consumed on federal property such as courthouses, airports and national parks.

4. Where can you consume cannabinoids in Woodbury?: Low-potency cannabinoids – like THC gummies and beverages -- continue to be legal to sell, possess and consume by individuals 21 and older. Much like liquor, they can be used in public spaces in Woodbury. However, they cannot be consumed at public or charter schools, on private property that prohibits the use, and cannot be consumed in vehicles – whether you are driving or riding as a passenger.

5. Who can sell what and when?

Sale of lower-potency cannabinoids – like THC gummies and beverages – continue to be legal in Woodbury, with a license issued by the City of Woodbury. The city allows sale at liquor stores, tobacco shops and other exclusive retailers. View licensing page.

No cannabis retail businesses are allowed in Woodbury until at least January 2025. Sales are currently allowed outside Woodbury on tribal land.

Home growing is now legal. Residents can grow up to eight plants at home (with no more than four being mature, flowering plants), as long as it is the primary residence of someone 21 and older and the property owner allows it. The plants must be in an enclosed, locked space that is not open for public view.

Cannabis seed sales also are now legal.
